Please read these terms of service ("terms of service", "terms") carefully before using Hourglass (“application”, “website”), operated by Congregation Software Foundation ("us", 'we", "our").
Conditions of Use
By registering a new congregation using this application, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly, and remove your account if one was created. Congregation Software Foundation only grants use and access of this application, its products, and its services to those who have accepted its terms.
Privacy Policy
You consent to and agree to our privacy policy regarding user data collection.
Data Processing Agreement
If your use of the application requires us to process personal data under a data processing agreement, Congregation Software Foundation will process such personal data subject to our Global Data Processing Agreement.
Age Restriction
To register a new congregation account, you must be at least 18 (eighteen) years of age. By registering, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. Congregation Software Foundation assumes no responsibility for liabilities related to age misrepresentation.
Intellectual Property
You agree that all materials, products, and services provided in this application are the property of Congregation Software Foundation, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute Congregation Software Foundation’s intellectual property in any way, including electronic, digital, or new trademark registrations.
User Accounts
As a registered user of this application, you may be asked to provide information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address it accordingly.
Applicable Law
By visiting this website, you agree that the laws of the United States, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Congregation Software Foundation and you, or its business partners and associates.
Disputes
You agree to resolve certain disputes with Congregation Software Foundation through binding arbitration (“Arbitration Agreement”). Arbitration means that an arbitrator, and not a judge or a jury, will decide the dispute. The parties expressly waive the right to bring or participate in any kind of class, collective, or mass action, private attorney general action, or any other representative action.
We want to address any Disputes without needing arbitration. If you have a Dispute with Congregation Software Foundation, prior to initiating arbitration, you agree to email an individualized request (“Pre-Arbitration Demand”) to info@hourglass-app.com so that we can work together to resolve the Dispute.
Indemnification
You agree to indemnify Congregation Software Foundation and its affiliates and hold Congregation Software Foundation harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on Liability
Congregation Software Foundation is not liable for any damages that may occur to you as a result of your use or misuse of our website.
Congregation Software Foundation reserves the right to edit, modify, and change this Agreement at any time. The current version of this Agreement will be available at https://www.hourglass-app.com/en/tos. This Agreement is an understanding between Congregation Software Foundation and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
